Please read these Terms and Conditions ("Terms") carefully before using PulseExtract. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. About PulseExtract

PulseExtract is an AI-powered document automation platform designed exclusively for licensed Florida family law attorneys and their support staff. The platform extracts structured financial data from client documents and assists in preparing Florida Form 12.902(b) and 12.902(c) Financial Affidavits. It also provides a secure client document upload portal.

PulseExtract is a productivity tool. It does not provide legal advice and does not create an attorney-client relationship between PulseExtract and any party.

2. Eligibility

You must be a licensed attorney, paralegal, legal assistant, or authorized staff member of a law firm to use PulseExtract. By creating an account, you represent that you are authorized to access client financial information in connection with legal proceedings and that your use of this platform complies with your professional responsibility obligations, including Florida Bar Rules of Professional Conduct.

3. Account Registration

Access to PulseExtract is by invitation only during our current demo-first period. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use at support@pulseextract.com.

4. Permitted Use

You may use PulseExtract solely for legitimate legal work in connection with active family law matters. You agree not to:

Upload documents you are not authorized to possess or process
Use the platform in any way that violates applicable law, court rules, or professional ethics rules
Attempt to reverse engineer, scrape, or extract underlying AI models or proprietary processing logic
Share account access with individuals outside your firm
Upload documents containing malware or malicious content

5. Client Portal and SMS Notifications

Attorneys may generate secure client upload portal links and optionally enable SMS or email notifications to their clients. By enabling SMS notifications for a client, you represent that:

You have obtained appropriate consent from the client to receive text messages, consistent with the Telephone Consumer Protection Act (TCPA) and applicable Florida law
The phone number provided belongs to the intended client
You have informed the client that standard message and data rates may apply

PulseExtract sends SMS messages only for document portal delivery and outstanding document reminders. Clients may opt out at any time by replying STOP. You remain solely responsible for compliance with TCPA and any applicable state telemarketing or consumer protection laws in connection with your use of SMS features.

6. AI-Generated Output and Attorney Responsibility

PulseExtract uses artificial intelligence to extract and categorize financial data. AI extraction is not infallible. All output — including extracted figures, affidavit drafts, and financial summaries — must be reviewed and verified by the responsible attorney before use in any legal proceeding.

PulseExtract is a drafting aid, not a replacement for attorney judgment. The attorney of record is solely responsible for the accuracy and completeness of any document filed with a court.

7. Data and Confidentiality

You are responsible for ensuring that your use of PulseExtract complies with your confidentiality obligations to your clients and with any applicable protective orders or discovery agreements governing the documents you upload.

We handle data as described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Subscription and Payment

Paid plans are billed on a monthly or annual basis. Fees are non-refundable except as required by law or as expressly stated in your subscription agreement. We reserve the right to modify pricing with reasonable advance notice. Failure to pay may result in suspension or termination of access.

9. Intellectual Property

PulseExtract and its underlying technology, AI models, and interface design are the exclusive property of PulseExtract. You retain all rights in your client documents and the legal work product generated from them. You grant PulseExtract a limited license to process your uploaded documents solely for the purpose of providing the service.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF EXTRACTED DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PULSEEXTRACT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO ERRORS IN AI-EXTRACTED DATA, COURT FILING ISSUES, OR UNAUTHORIZED ACCESS TO UPLOADED DOCUMENTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold PulseExtract harmless from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any applicable law or professional rule.

13. Termination

Either party may terminate the agreement at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to access the platform ceases. You may request export of your matter data within 30 days of termination by contacting support@pulseextract.com.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved by binding arbitration in Florida, except that either party may seek injunctive relief in a court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes. Continued use after changes become effective constitutes acceptance.
